WildKind Terms of Use

WildKind is created and operated by Celestial Works LLC.

These Terms of Use explain the rules for downloading, accessing, or using WildKind. By downloading, installing, accessing, or using WildKind, you agree to these Terms.

If you do not agree to these Terms, do not use WildKind.

1. About WildKind

WildKind is a mobile wildlife discovery app that may include species identification, camera scanning, photo uploads, personal wildlife collections, sighting logs, maps, nearby species, location-based features, family features, parent approval features, account features, badges, streaks, reminders, purchases, subscriptions, paywalls, premium features, AI-assisted features, settings, and other app features.

WildKind is provided for personal wildlife discovery, education, and entertainment use only.

WildKind is not a safety service, emergency service, scientific authority, animal control service, medical provider, legal advisor, park authority, conservation authority, navigation service, or professional wildlife guide.

We may update, change, add, remove, pause, limit, disable, or discontinue any part of WildKind at any time, including free features, paid features, account features, maps, identification tools, AI features, family features, parent approval features, badges, streaks, subscriptions, or backend services.

2. License to Use WildKind

Celestial Works LLC gives you a limited, personal, non-exclusive, non-transferable, revocable license to use WildKind for personal, non-commercial wildlife discovery, education, and entertainment purposes.

You do not own WildKind or any part of the app.

WildKind, including its name, branding, logo, design, artwork, interface, maps, layouts, templates, gameplay-like systems, collection systems, badge systems, animations, text, code, content, systems, and features, is owned by Celestial Works LLC or its licensors.

You may not copy, sell, rent, lease, sublicense, distribute, modify, reverse engineer, decompile, hack, exploit, clone, resell, or commercially use WildKind or its content without written permission from Celestial Works LLC.

All rights not expressly granted to you are reserved.

3. Personal Use

WildKind is intended for personal wildlife discovery, education, family exploration, and entertainment.

You may use WildKind to scan wildlife, save sightings, build a personal collection, learn about species, view maps, track personal discovery progress, and use family features where available.

You may not use WildKind as a professional scientific database, official species record system, emergency system, animal control system, school record system, park authority system, legal compliance system, commercial wildlife survey system, hunting or fishing guide, foraging guide, pest control system, medical safety tool, or professional conservation service without written permission from Celestial Works LLC.

You are responsible for deciding what information you enter, upload, save, rely on, copy, export, screenshot, publish, message, print, or share.

4. Guest Use and Local Data

WildKind may allow you to use some features as a guest or without creating an account.

Guest or local-only information may be stored locally on your device and may not be connected to an online account.

Guest or local-only information may not be saved to our database unless you later use an account-based feature that supports syncing, cloud backup, account recovery, publishing, family features, or online storage.

This means:

• If you delete the app, your local-only data may be lost.
• If you switch phones or devices, your local-only data may not transfer.
• If your phone is lost, reset, damaged, replaced, or wiped, local-only data may be lost.
• If your local device storage is cleared, local-only data may be lost.
• If the app is removed, reinstalled, or reset, local-only data may be lost.
• We cannot manually restore local-only data if we do not store it on our servers.

You are responsible for understanding the risk of using guest or local-only features.

To the fullest extent allowed by law, Celestial Works LLC is not responsible for lost sightings, lost photos, lost notes, lost collections, lost badges, lost streaks, lost settings, lost map data, lost family data, lost account data, or lost local data.

5. Accounts and Sign-In

WildKind may allow you to sign in with Apple, Google, Facebook, email, or other supported login providers.

You are responsible for keeping your account secure and for all activity connected to your account.

You agree not to:

• Use another person's account
• Impersonate another person
• Provide false or misleading account information
• Attempt to access accounts or data that do not belong to you
• Abuse authentication systems
• Interfere with account security or login systems
• Share account access with people you do not trust

Signing in does not automatically unlock paid features, premium features, subscriptions, family features, or premium content.

We may suspend, limit, disable, or delete access to account features if we believe there is fraud, abuse, misuse, security risk, policy violation, platform violation, child safety risk, conservation risk, privacy risk, or legal risk.

6. Age Information, Children, and Parent Approval

WildKind may ask for your date of birth or age range to help determine which app experience is appropriate.

If a user is under 13, WildKind may require parent or guardian approval before certain account features, online features, sharing features, publishing features, family features, location features, or data storage features are available.

If a user is under 18, WildKind may require parent or guardian permission before using certain features.

Parents and guardians are responsible for supervising children's use of WildKind, including camera use, photo uploads, location use, map use, sharing, published sightings, purchases, subscriptions, third-party links, outdoor exploration, and wildlife safety.

Children should not use WildKind outdoors without appropriate adult supervision.

We may limit, disable, delete, or restrict access to child accounts, family features, publishing features, or location features if we believe there is a child safety risk, privacy risk, legal risk, or violation of these Terms.

7. Purchases, Subscriptions, Paywalls, and Premium Features

WildKind may offer optional paid features, including subscriptions, premium tools, family plans, additional scans, identification features, advanced map features, collection features, sponsor features, paywalls, or other paid benefits.

Purchases and subscriptions are processed by the platform where you downloaded the app, such as the Apple App Store or Google Play.

Celestial Works LLC does not process your payment directly and does not receive or store your full credit card number, debit card number, bank account information, payment account password, or complete payment details.

Subscription billing, renewal, cancellation, refunds, chargebacks, taxes, payment methods, payment disputes, free trials, introductory offers, and billing problems are managed by Apple or Google according to their own rules and policies.

You are responsible for reviewing the price, billing period, renewal terms, trial terms, cancellation terms, and paywall details shown before purchasing or subscribing.

Subscriptions may renew automatically unless you cancel through your Apple App Store or Google Play account settings before the renewal date.

Deleting the app, deleting local app data, signing out, deleting your WildKind account data, deleting local-only data, or uninstalling WildKind does not automatically cancel an active Apple App Store or Google Play subscription.

You must manage or cancel subscriptions through your Apple App Store or Google Play account settings.

We may change, add, remove, rename, rebalance, limit, or discontinue paid features, free features, premium features, identification limits, family features, maps, scans, badges, streaks, sponsor features, or content where allowed by law and platform rules.

8. Refunds

Refunds for purchases or subscriptions are handled by the platform that processed the purchase, such as Apple App Store or Google Play.

Celestial Works LLC does not control Apple or Google refund decisions.

If you want a refund, you must request it through the platform that processed your purchase.

We are not responsible for refund denials, billing disputes, subscription renewal issues, payment method issues, chargebacks, cancellation mistakes, or account issues controlled by Apple, Google, or another platform provider.

9. Camera, Photos, and Uploaded Content

WildKind may allow you to take, upload, save, scan, or publish wildlife photos, screenshots, notes, location details, or other content.

You are responsible for the content you choose to capture, upload, attach, save, publish, or share.

Photos may include metadata or visual details that reveal location, time, surroundings, people, homes, schools, parks, landmarks, license plates, addresses, children, private property, or other private information.

Do not upload, save, publish, or share photos that include private information, faces of children, people who did not consent, private property, addresses, school locations, or other sensitive details unless you have permission and are comfortable storing or sharing that content.

You agree not to upload, attach, save, publish, or share content that:

• You do not have permission to use
• Violates another person's privacy
• Contains illegal, harmful, abusive, or exploitative material
• Contains malware, harmful code, spam, or attacks
• Misrepresents species, safety, legal, medical, scientific, or professional information
• Reveals sensitive child locations, home locations, school locations, private property, protected habitats, nests, dens, endangered species locations, or other sensitive locations in a harmful way
• Violates any law, platform rule, park rule, property rule, or third-party right

We may remove, limit, hide, blur, generalize, delay, disable, or delete content, location information, sightings, photos, maps, account access, or sharing features if we believe there is legal risk, privacy risk, child safety risk, conservation risk, security risk, misuse, abuse, or violation of these Terms.

10. Location, Maps, and Published Sightings

WildKind may use location information to support maps, nearby species, personal sightings, location search, wildlife discovery, family map views, or published sightings.

You are responsible for how you use location features and what location information you save, publish, or share.

You should be careful when saving, publishing, or sharing location-based sightings.

Do not publish or share locations that reveal your home, school, child's location, private property, endangered species locations, sensitive habitats, nests, dens, rare species, protected species, or places where sharing could create safety, privacy, legal, trespassing, or conservation risks.

WildKind may blur, generalize, hide, delay, remove, or limit certain location information for privacy, safety, child protection, conservation, moderation, abuse-prevention, or legal reasons.

If you publish or share sightings, other users or third parties may be able to view, copy, screenshot, save, or use that information outside WildKind.

We cannot control what others do with information you choose to publish or share.

11. Outdoor Safety and Wildlife Safety

WildKind may include outdoor exploration features, maps, nearby species, camera scanning, educational content, and wildlife discovery tools.

WildKind does not guarantee your safety outdoors.

WildKind does not tell you whether an animal, plant, mushroom, location, trail, waterway, weather condition, park, road, neighborhood, or outdoor situation is safe.

You agree not to use WildKind in a way that puts you, a child, another person, an animal, or the environment at risk.

Do not approach, touch, feed, chase, trap, disturb, harass, remove, relocate, injure, or handle wild animals.

Do not disturb nests, dens, eggs, young animals, protected habitats, endangered species, or sensitive areas.

Do not trespass, enter private property, enter restricted areas, enter dangerous areas, walk into roads, cross unsafe terrain, ignore signs, ignore park rules, or enter closed parks, protected habitats, construction zones, unsafe trails, waterways, cliffs, caves, or other risky places.

Do not rely on WildKind for emergency help, navigation safety, legal access, weather safety, animal danger, venomous species identification, poisonous plant or mushroom identification, wildlife handling, medical decisions, or child supervision.

Parents and guardians are responsible for supervising children outdoors.

For emergencies, contact emergency services or the appropriate local authority.

12. Species Identification and AI Features

WildKind may use AI-assisted tools, computer vision, species databases, third-party identification services, or other automated systems to help identify wildlife from photos, sightings, or observations.

These services may include providers such as OpenAI, Anthropic, Google Vision, GBIF, iNaturalist, or other identification, AI, wildlife data, or species information providers.

Species identification results, AI output, maps, species descriptions, scientific names, common names, taxonomy, conservation status, occurrence data, or other wildlife information may be incomplete, inaccurate, outdated, uncertain, unavailable, or inappropriate for your location.

WildKind does not guarantee that species identification results are correct.

You should not rely on WildKind for safety decisions, medical decisions, venomous species identification, poisonous plant or mushroom identification, wildlife handling, legal compliance, hunting, fishing, foraging, pest control, emergency decisions, conservation decisions, or professional scientific decisions.

AI features do not provide medical, legal, safety, wildlife handling, emergency, conservation, scientific, or other professional advice.

You are responsible for reviewing, verifying, and deciding whether to use or share any AI-generated content or species identification result.

Always use caution outdoors and contact qualified professionals or official sources when needed.

We may change, limit, disable, remove, or discontinue AI features or species identification features at any time.

13. Species Data and Third-Party Wildlife Information

WildKind may display species information, images, maps, names, descriptions, taxonomy, conservation status, occurrence data, sightings, or other wildlife information from third-party sources.

Third-party wildlife information may be incomplete, outdated, inaccurate, unavailable, or different across providers.

We do not guarantee the accuracy, completeness, availability, legality, or safety of third-party wildlife information.

Your use of third-party wildlife data may be subject to the provider's own terms, licenses, and privacy policies.

14. Family Features

WildKind may include family account features, parent approval, private family map views, child profiles, shared collections, or family activity features.

Family features may allow parents or guardians to view child activity, sightings, collection progress, badges, or location-based records.

Parents and guardians are responsible for managing family access and deciding what information is appropriate to share within a family account.

Do not invite or allow people into family features unless you trust them.

We are not responsible for family disputes, shared account misuse, incorrect permissions, unauthorized access by invited family members, or information shared within a family account by users you allowed.

15. Notifications and Reminders

WildKind may allow you to receive notifications or reminders.

Notifications may include reminders, weekly creature updates, badge updates, streak reminders, parent approval messages, account notices, safety notices, or other app-related messages.

Notifications may fail, delay, repeat, disappear, or not be delivered because of device settings, app settings, notification permissions, operating system behavior, battery settings, network issues, time zone issues, service outages, app bugs, or technical errors.

You should not rely on WildKind notifications for emergencies, child safety, location safety, outdoor safety, legal deadlines, weather alerts, dangerous wildlife warnings, or time-sensitive obligations.

You are responsible for managing notification permissions and lock screen privacy settings on your device.

Celestial Works LLC is not responsible for missed reminders, delayed notifications, incorrect reminder settings, lock screen privacy issues, or consequences related to notification failures.

16. Ads and Third-Party Content

WildKind may show ads in the future, including rewarded ads, interstitial ads, banner ads, sponsor placements, or other ad formats.

Ads may be provided by third-party ad networks, including Google AdMob.

We do not control the specific ads shown, the products or services advertised, or the websites, apps, services, offers, subscriptions, purchases, or pages that ads may link to.

If you tap an ad, download another app, make a purchase, subscribe to another service, sign up for an account, communicate with an advertiser, or share information with a third party, that interaction is between you and the third party.

Celestial Works LLC is not responsible for:

• The content of third-party ads
• Products, services, apps, websites, subscriptions, or offers shown in ads
• Purchases, downloads, subscriptions, charges, refunds, cancellations, or disputes related to ads
• Information you choose to share with advertisers or third-party services
• How third-party advertisers collect, use, store, sell, disclose, or share your information
• Any issue, loss, damage, charge, subscription, dispute, claim, or harm related to a third-party ad, advertiser, website, app, product, or service

You should review the privacy policy and terms of any third-party service before sharing information, downloading apps, signing up, subscribing, or making purchases.

17. Sponsor Features

WildKind may include sponsor features, sponsored content, sponsor placements, partner content, educational placements, or other sponsor-supported features.

Sponsored content may be labeled where required by law or platform rules.

We do not guarantee sponsor products, services, claims, links, offers, websites, apps, or third-party content.

If you interact with sponsor content, links, offers, websites, apps, or services, that interaction is between you and the third party.

Celestial Works LLC is not responsible for sponsor content, sponsor claims, sponsor websites, third-party purchases, third-party subscriptions, charges, refunds, cancellations, disputes, or privacy practices.

18. Acceptable Use

You agree not to:

• Use WildKind for illegal, harmful, abusive, deceptive, or fraudulent purposes
• Use WildKind as an emergency system, medical system, animal control system, navigation safety system, park authority system, legal compliance system, hunting guide, fishing guide, foraging guide, scientific authority, or professional wildlife service
• Use WildKind to harass, disturb, harm, trap, chase, feed, exploit, relocate, or endanger animals, people, children, habitats, parks, or protected areas
• Use WildKind to reveal sensitive locations, child locations, home locations, school locations, endangered species locations, nests, dens, private property, restricted areas, or protected habitats in a harmful way
• Trespass, ignore park rules, ignore property rules, violate wildlife laws, violate conservation rules, or violate local regulations while using WildKind
• Hack, exploit, reverse engineer, decompile, modify, attack, or interfere with the app
• Abuse purchases, subscriptions, promo codes, account systems, premium features, location features, AI features, identification features, family features, or app features
• Use bots, scripts, automation, emulators, modified clients, fake accounts, unauthorized tools, or other methods to manipulate purchases, subscriptions, account access, premium features, scans, sightings, badges, streaks, identification results, or app behavior
• Attempt to bypass paywalls, subscriptions, entitlement checks, access controls, security checks, age checks, parent approval, or purchase validation
• Attempt to access, alter, delete, scrape, copy, or misuse data that does not belong to you
• Upload, transmit, or introduce malware, harmful code, attacks, spam, or abusive behavior
• Copy, resell, redistribute, clone, publish, or commercially exploit WildKind or its content
• Misrepresent your relationship with Celestial Works LLC
• Use WildKind in a way that violates Apple, Google, Meta, AdMob, Supabase, Mapbox, OpenAI, Anthropic, Google Vision, GBIF, iNaturalist, Resend, or other third-party platform rules
• Use WildKind in a way that could damage, disable, overburden, disrupt, or impair the app, our systems, or our service providers

We may suspend, limit, disable, or remove access if we believe you violated these Terms or used the app in a harmful, fraudulent, abusive, unauthorized, unsafe, or risky way.

19. App Availability and Changes

WildKind is provided as a small independent app.

We do not guarantee that WildKind will always be available, uninterrupted, secure, error-free, bug-free, compatible with every device, compatible with every operating system, or free from crashes, data loss, service interruptions, notification failures, map issues, sync failures, identification failures, AI issues, or other issues.

We may update, change, pause, remove, limit, disable, or discontinue any part of WildKind at any time.

We may also remove WildKind from app stores, stop supporting the app, stop providing updates, disable online features, add or remove paid features, change subscriptions, change premium features, change identification limits, change family features, change map features, change badges, change streaks, or discontinue the app at any time where allowed by law and platform rules.

20. Data Loss and Content Loss

You understand that sightings, photos, notes, maps, locations, collections, badges, streaks, settings, account data, local-only data, child profiles, family data, parent approvals, published sightings, purchases, entitlements, AI results, species identification results, or other app data may be lost, changed, delayed, unavailable, corrupted, hidden, removed, moderated, blurred, generalized, or reset because of bugs, device issues, app deletion, app reinstall, operating system updates, local storage clearing, account issues, backend issues, subscription issues, platform issues, network issues, service interruptions, fraud prevention, moderation, privacy protection, conservation protection, child safety protection, app updates, or other events.

Local-only data is stored on your device and may be lost if the app is deleted, your device is replaced, your device is reset, your device storage is cleared, or your device is damaged or lost.

To the fullest extent allowed by law, Celestial Works LLC is not responsible for lost sightings, lost photos, lost notes, lost maps, lost locations, lost collections, lost badges, lost streaks, lost settings, lost account data, lost local-only data, lost child profiles, lost family data, lost parent approvals, lost published sightings, lost AI results, lost species identification results, or lost app data.

21. Ownership and Intellectual Property

WildKind, including its name, branding, logo, design, artwork, interface, maps, templates, layouts, collection systems, badge systems, animations, text, code, content, systems, and other materials, is owned by Celestial Works LLC or its licensors.

You may not copy, reproduce, modify, distribute, sell, publish, display, perform, create derivative works from, scrape, extract, or use WildKind content outside the app without written permission.

You may not use the WildKind name, Celestial Works LLC name, logos, branding, app content, designs, screenshots, artwork, or other materials in a way that suggests endorsement, partnership, ownership, or permission unless we give written approval.

All rights not expressly granted are reserved.

22. User Content

You may enter, upload, save, publish, or share photos, sightings, notes, locations, comments, collections, profile information, or other content in WildKind.

You keep ownership of the content you enter into WildKind.

You give Celestial Works LLC permission to store, process, display, transmit, back up, moderate, modify for safety or privacy, and use your content as needed to provide, operate, secure, support, improve, and maintain WildKind and its features.

If you publish or share content, you give Celestial Works LLC permission to display, distribute, and make that content available through WildKind and related app features.

You are responsible for your content and for making sure you have the right to enter, upload, save, publish, or share it.

We are not required to monitor, review, verify, correct, preserve, or publish user content.

We may remove, hide, generalize, blur, limit, disable, or delete user content if we believe there is safety risk, privacy risk, child safety risk, conservation risk, legal risk, security risk, misuse, abuse, or violation of these Terms.

23. User Feedback

If you send us ideas, feedback, suggestions, bug reports, feature requests, comments, concepts, designs, improvements, or other input about WildKind, you allow Celestial Works LLC to use that feedback without restriction, payment, credit, approval, or obligation to you.

We are not required to use, credit, pay for, keep confidential, review, or respond to feedback.

24. Third-Party Services

WildKind may depend on third-party services, including Apple, Google, Facebook / Meta, Supabase, Mapbox, Google Vision, OpenAI, Anthropic, GBIF, iNaturalist, Resend, purchase processors, analytics providers, crash-reporting providers, hosting providers, authentication providers, app stores, notification providers, AI providers, map providers, species data providers, and other service providers.

We are not responsible for third-party service outages, data practices, policies, errors, billing issues, account issues, login issues, refund issues, platform changes, service changes, security events, AI output, species data, identification results, map data, location results, parent approval email delivery, or decisions made by those third parties.

Your use of third-party services may be subject to their own terms, privacy policies, licenses, and platform rules.

25. Children

WildKind is intended for users who are old enough to use the app safely and responsibly, and for children only with appropriate parent or guardian permission and supervision.

WildKind is not directed to children under 13 to use online account features without required parent or guardian approval.

If you are under the age required to use apps or online services in your location, you should use WildKind only with permission from a parent or guardian.

Parents and guardians are responsible for supervising children's use of the app, including account access, camera use, photo uploads, location use, maps, published sightings, family features, subscriptions, purchases, notifications, shared content, device settings, parental controls, screen time, outdoor exploration, and wildlife safety.

26. No Professional Advice

WildKind is a wildlife discovery, education, and entertainment app.

WildKind does not provide professional, financial, medical, legal, educational, scientific, conservation, wildlife handling, hunting, fishing, foraging, navigation, emergency, safety, park access, animal control, or other professional advice.

You should not rely on WildKind as a substitute for qualified professionals, emergency services, official records, medical instructions, legal advice, wildlife authorities, park rules, conservation laws, local regulations, weather services, maps designed for navigation, or adult supervision.

27. No Warranty

WildKind is provided "as is" and "as available."

To the fullest extent allowed by law, Celestial Works LLC makes no warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, reliability, security, compatibility, uninterrupted operation, or error-free operation.

We do not promise that WildKind will meet your expectations, work on every device, operate without interruption, preserve data, remain available, remain unchanged, deliver notifications correctly, sync correctly, identify species correctly, display maps correctly, provide accurate wildlife information, or be free from bugs, crashes, errors, data loss, security issues, or service interruptions.

28. Limitation of Liability

To the fullest extent allowed by law, Celestial Works LLC and its owners, members, employees, contractors, partners, service providers, affiliates, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages.

This includes damages related to:

• Use of or inability to use WildKind
• Lost sightings, lost photos, lost notes, lost maps, lost locations, lost collections, lost badges, lost streaks, lost settings, lost data, lost local-only data, lost account data, lost child profiles, lost family data, lost parent approvals, lost published sightings, lost AI results, lost species identification results, or lost app content
• App crashes, bugs, errors, outages, interruptions, delays, sync issues, notification failures, map issues, location issues, identification failures, AI issues, or compatibility issues
• Purchases, subscriptions, cancellations, refunds, billing disputes, payment issues, renewal issues, free trials, or platform issues handled by Apple or Google
• Ads, advertisers, sponsor content, third-party links, third-party apps, third-party purchases, third-party subscriptions, or third-party services
• Account access issues, login provider issues, backend issues, service provider issues, authentication issues, parent approval issues, or sync issues
• Device issues, operating system changes, app store changes, network issues, local storage issues, camera issues, photo library issues, notification issues, or location permission issues
• AI-generated content, inaccurate information, incomplete summaries, incorrect species identification, incorrect maps, incorrect location data, or reliance on app-generated content
• Outdoor activity, wildlife encounters, animal bites, stings, injuries, allergic reactions, poisonous plants, poisonous mushrooms, venomous species, unsafe terrain, trespassing, park access, weather conditions, navigation issues, child supervision, or emergency situations
• Legal decisions, conservation decisions, hunting decisions, fishing decisions, foraging decisions, animal handling decisions, medical decisions, safety decisions, or professional decisions
• Unauthorized access, fraud, misuse, invalid activity, security events, or events beyond our reasonable control

To the fullest extent allowed by law, Celestial Works LLC's total liability for any claim related to WildKind will not exceed the amount you paid directly for WildKind in the 3 months before the claim, or 25 US dollars, whichever is greater.

Some locations do not allow certain warranty disclaimers or liability limits, so some of these limits may not apply to you.

29. Indemnity

To the fullest extent allowed by law, you agree to defend, indemnify, and hold harmless Celestial Works LLC and its owners, members, employees, contractors, partners, service providers, affiliates, and licensors from claims, damages, losses, liabilities, costs, and expenses, including reasonable legal fees, related to:

• Your use or misuse of WildKind
• Your violation of these Terms
• Your violation of any law, regulation, platform rule, park rule, property rule, conservation rule, wildlife rule, or third-party right
• Your fraud, abuse, exploitation, invalid activity, or unauthorized activity
• Your interactions with ads, sponsor content, advertisers, third-party links, third-party apps, third-party purchases, or third-party services
• Any content, information, photos, sightings, notes, locations, published content, or feedback you submit to us
• Any information you publish, share, copy, export, screenshot, message, print, or send to other users or third parties

30. Account and Data Deletion

If account features are available, you may request deletion of your WildKind account data by contacting:

Deleting WildKind account data does not automatically cancel an active Apple App Store or Google Play subscription.

You must cancel subscriptions through your Apple App Store or Google Play account settings.

Local-only data may be stored only on your device. We cannot recover, transfer, restore, or delete local-only data from our servers if we do not store it in our database.

Some data may be retained where required or permitted for legal, security, fraud prevention, tax, accounting, payment, dispute, backup, child safety, conservation protection, moderation, or platform compliance reasons.

31. Parent or Guardian Requests

Parents or guardians may contact us to request deletion of child account data or personal information that may have been provided by a child under 13 without required permission.

32. Privacy Policy

Your use of WildKind is also covered by our Privacy Policy.

The Privacy Policy explains what information may be collected, used, stored, or shared when you use the app.

By using WildKind, you also agree to the Privacy Policy.

33. App Store and Platform Terms

Your use of WildKind may also be subject to the rules, terms, and policies of the platform where you downloaded the app, including Apple App Store or Google Play.

If there is a conflict between these Terms and required Apple or Google platform rules, the required platform rules may apply where necessary.

Apple, Google, Meta, AdMob, Supabase, Mapbox, OpenAI, Anthropic, Google Vision, GBIF, iNaturalist, Resend, and other third-party providers are not responsible for providing support, maintenance, refunds, or warranties for WildKind unless their own terms say otherwise.

34. Termination

We may suspend, limit, disable, or terminate your access to WildKind or any feature of WildKind at any time if we believe you violated these Terms, violated platform rules, created risk, engaged in fraud or abuse, created child safety risk, created privacy risk, created conservation risk, or used the app in a harmful, unsafe, or unauthorized way.

You may stop using WildKind at any time by deleting the app.

Deleting the app does not automatically cancel subscriptions. You must cancel subscriptions through Apple App Store or Google Play.

35. Changes to These Terms

We may update these Terms from time to time.

If we make changes, we will update the effective date and make the latest version available in the app or on our website.

Your continued use of WildKind after updated Terms are posted means you accept the updated Terms.

36. Governing Law

These Terms are governed by the laws of the State of Georgia, United States, without regard to conflict of law rules.

If a dispute is allowed to proceed in court, it will be handled in the state or federal courts located in Georgia, unless applicable law requires otherwise.

37. Severability

If any part of these Terms is found to be invalid, illegal, or unenforceable, the remaining parts will remain in effect.

38. Entire Agreement

These Terms, together with the Privacy Policy and any purchase terms shown in the app or by the app store, make up the agreement between you and Celestial Works LLC for your use of WildKind.
